Why do I need a lawyer?

Divorce – or the dissolution of a civil partnership – is a formal process which requires an application to a Court, usually a Sheriff Court.

There are different types of court applications, depending on the financial and other circumstances, and whether the couple has children under the age of 16 at the time the divorce is sought.

Grounds for divorce

There is only one ground of divorce in Scotland – that the marriage (or civil partnership) has broken down irretrievably and that there is no prospect of a reconciliation.

There are four different ways to establish that irretrievable breakdown:

  • Separation for one year, with both parties consenting;
  • Separation for two years with no consent required;
  • Adultery; and
  • Unreasonable behaviour.
