What is defamation?

Defamation occurs when something is communicated which is untrue and causes, or is likely to cause, serious harm to the reputation of a person.

In certain cases, it may be possible to bring legal action against the author, editor or publisher of a statement.

The right to commence proceedings is limited by, and remedies set out in, the new Defamation and Malicious Publication (Scotland) Act 2021.
