Getting the best advice

Whether there is a will in place or should an estate fall to be divided in accordance with the law where there is no will (known as ‘intestacy’), our team deals with the formalities of winding up the estate as promptly as possible whilst keeping our clients regularly updated and keeping costs to a minimum.

Our lawyers are all aware of the impact an inheritance can have on the financial affairs of beneficiaries, and can work closely with any financial advisors, accountants or other financial professionals involved to ensure that beneficiaries are afforded the best possible advice as to the transfer, encashment and reinvestment of estate assets.

We can also assist with alterations to the expected distribution of assets. This can be simply to redress any perceived imbalances in the terms of the original will or, more generally, for tax and estate planning reasons.

Advising on your rights

Scots law provides that some individuals (spouses, children and cohabiting partners) may have certain rights in an estate, whatever the terms of a will.

Where this is the case, we can provide advice on legal rights, cohabitants' claims and other entitlements from estates.

Additionally, our Private Client and Dispute Resolution teams can work closely together to provide advice in contentious estate matters, such as challenges to Wills.
